01 — These terms

These Terms of Service govern any package or plan purchased, or any project commissioned, through buildstackstudio (Av. Gen. Humberto Delgado 30, 2560-272 Torres Vedras, Portugal), whether via /checkout or agreed directly with your point of contact. By placing an order or engaging buildstackstudio for a project, you agree to these terms.

02 — What we sell

buildstackstudio sells fixed-scope packages for website design & build, product design (UX/UI), web app development, brand identity, e-commerce builds, and a monthly Care & Growth Retainer, as published on /pricing and each service page. Each package states its price, what's included, its timeline and its revision terms. One tier — Custom platform, under Web App Development — is enquiry-only and scoped individually rather than sold at a fixed published price.

03 — Prices & payment

All prices are shown in EUR, exclusive of VAT. VAT is calculated at checkout: 23% for Portugal and the rest of the EU without a valid VAT number, 0% (reverse charge) for VAT-registered businesses elsewhere in the EU, and 0% (export of services) for clients outside the EU. This is a simplified model; if your situation is unusual, tell us before checkout.

One-off packages under €5,000 are charged in full at checkout. Larger one-off packages require a deposit at checkout, stated per package; the balance is invoiced at the milestones stated in that package (typically design sign-off and launch) and is due on receipt of that invoice. Care & Growth Retainer plans are billed monthly in advance, starting on the date of your first charge.

The checkout on this site currently runs on a demonstration payment flow: no real payment is taken, and no card details are ever stored or transmitted through it. To place a real order, contact support@buildstackstudio.com and we'll confirm payment by invoice or bank transfer.

04 — Timelines & revisions

Timelines stated per package begin once Scope is agreed and any required deposit is paid — not from the date of your order. Each package states its included revision rounds; additional revisions beyond that are quoted separately at a stated rate and agreed before any extra work begins. Timelines assume timely feedback and content from you; delays on your side may extend the delivery date accordingly.

05 — Ownership

On full payment, all code, design files, and content produced specifically for your project transfer to you. Nothing delivered under these terms is licensed back to buildstackstudio. buildstackstudio retains no ownership claim over the finished work, though we may reference completed projects (with your permission) in future portfolio or marketing material.

06 — Right of withdrawal (EU consumers)

If you're a consumer based in the EU, you generally have the right to withdraw from an online purchase within 14 days without giving a reason, under the EU Consumer Rights Directive as implemented in Portugal (Decreto-Lei n.º 24/2014).

This right has a specific, important exception for the kind of work buildstackstudio sells: because our packages are services performed to your specifications and personalised to your project, the withdrawal right is lost once we begin work with your express prior consent and your acknowledgement that you lose the right to withdraw once performance has started. In practice, this means: the checkout review step asks you to confirm this before you pay, and once Scope work begins on the agreed start date, the 14-day withdrawal right no longer applies to that package. If you cancel before work begins, the Refund & Cancellation Policy governs any refund instead.

07 — Your responsibilities

To keep a project on its stated timeline, you agree to provide requested content, feedback and approvals within a reasonable time, hold any licences needed for content you supply (text, images, trademarks), and pay invoices for deposits and balances by their due date. Delays on your side may extend timelines and, for extended pauses, may be treated as a cancellation under the Refund & Cancellation Policy.

08 — Cancellation

Cancellation, rescheduling and refund terms — including the deposit-refund rule, the 24-hour rule for booked calls, and the monthly retainer cancellation terms — are set out in full in the Refund & Cancellation Policy, which forms part of these Terms.

09 — Liability

buildstackstudio delivers work to the standard agreed in Scope and to generally accepted professional standards. To the extent permitted by Portuguese law, our liability for any claim arising from a project is limited to the amount actually paid for that package. We're not liable for indirect or consequential losses (such as lost profits or lost business) arising from the use of delivered work, except where such liability cannot be excluded under mandatory Portuguese or EU consumer law.

10 — Governing law & disputes

These terms are governed by the law of Portugal. Any dispute will first be handled directly with your point of contact; if it can't be resolved this way, EU consumers can refer it to the European Online Dispute Resolution platform (ec.europa.eu/consumers/odr) or to a Portuguese consumer arbitration centre (a current list is maintained by the Direção-Geral do Consumidor). Otherwise, the Portuguese courts have jurisdiction.

11 — Changes to these terms

We may update these terms as our services change. The "Last updated" date reflects the most recent revision; terms in force at the time you place an order govern that order.
